Products Liability
It is the responsibility of a manufacturer to market safe and harmless products. Product liability is caused as a result of defects in manufacture, design, or marketing of a product, or the failure to warn or caution about the performance of a product. It also arises as a result of gas and chemical explosions. The person to be held liable may be the manufacturer, distributor, wholesaler, or the retailer. Liability is determined based on the theories of strict liability, negligence, and fitness warranty. The kinds of damages that can be claimed include compensatory, pain and suffering, loss of consortium, and punitive damages.
