Wrongful Death
A wrongful death is caused as a result of a negligent act of a person, where the claimant should prove that the death was due to the careless or negligent act of the defendant. The matters to be taken into account before allowing a claim for damages are medical costs, funeral expenses, and the average income the deceased would have generated had he been alive. The heirs, dependants, and survivors of the deceased can file a lawsuit for the loss and damage incurred against the person who caused the wrongful death. The limitation period for filing a wrongful death suit differs from one state to another.
